At Cue Connect, we know that your privacy is important to you. This Privacy Policy describes our privacy practices with respect to the information that we receive through the cueconnect.com website (the “Site”) and all related mobile components, mobile communications services (such as SMS texts), APIs, software, and services that we provide (each a “Service” and, together with the Site, our “Services”). This Privacy Policy is part of the Terms of Use that govern your use of our Services.

By using our Services, you explicitly consent to the collection, use, and disclosure of your information as described in this Privacy Policy and accept the terms of this Privacy Policy.

Because the Internet is global, information about you that we collect or that you submit may be transferred to, processed, and held in countries (including the United States) other than the one in which you live, where laws regarding processing of your personal information may be less stringent than the laws in your country. By using our Services, you explicitly consent to such transfer, processing, and storage.

We may update this privacy policy to reflect changes to our information practices. If we make any material changes we will notify you by email (sent to the e-mail address specified in your account) or by means of a notice on this Site prior to the change becoming effective. Our primary goal in collecting information from you is to provide you with a smooth, efficient, and customized experience while using our Services. We collect two types of information about our users: Personally Identifiable Information and Non-Personally Identifiable Information.

Personally Identifiable Information is information that lets us know the specifics of who you are, such as your first and last name, mailing address, zip code, email address, telephone and facsimile numbers, usernames and passwords for social networks and other third party services, credit card numbers, birthdays, and other personal identifying information.

Non-Personally Identifiable Information is information that does not, by itself, identify a specific individual, such as the Uniform Resource Locator (“URL”) of the website that you were using before coming to our Site or using our Services, which URL you go to next, what browser or mobile device you are using to access our Services, and location data (such as GPS and cell location data for the device on which you are accessing or using our Services).

We collect your location based information for the purpose of [locating a place that you may be searching for in your area]. We will only share this information with our mapping provider for the sole purpose of providing you this service. We will share your personal information with third parties only in the ways that are described in this privacy statement. We collect Personally Identifiable Information about you when you voluntarily provide it to us, whether you provide it to us directly or you authorize us to access Personally Identifiable Information you may have provided to third parties with whom we have an arrangement that permits us to integrate their service offerings with our own (our “Service Partners”), and when another user of our Services provides your telephone number, email address, or other contact information in order to share an item with you. For example, you may authorize us to access your Personally Identifiable Information stored in your account with a Service Partner such as a merchant or a social network. When you use particular aspects of our Services, such as registering for a membership, ordering a product or service, signing up for special offers, submitting content and/or posting content in public areas, entering a contest or sweepstakes, filling out a survey, or sending us feedback, we may ask you to provide Personally Identifiable Information. We may also collect Personally Identifiable Information from you at other points in our Services that state that such information is being collected. You are free to choose whether or not to provide the requested information. However, you may not be able to use all of our Services if you do not provide the requested Personally Identifiable Information.

We use your Personally Identifiable Information to provide our Services to you. For example, when you register for our Services, we will use the mobile phone number and email address you provide to validate your registration. We will also use Personally Identifiable Information to enhance the operation of our Services, improve our marketing and promotional efforts, statistically analyze use of our Services, update and enhance our records, and customize the content, layout, and features of our Services. For example, we use your Personally Identifiable Information to recommend products and services that you may be interested in based upon your previous history of using our Services. We will use Personally Identifiable Information to deliver information to you and to contact you. We also use Personally Identifiable Information to resolve disputes, troubleshoot problems and enforce our agreements with you, including our Terms of Use and this Privacy Policy.

Our Services automatically collect Non-Personally Identifiable Information based upon your use of our Services. We compile and analyze Non-Personally Identifiable Information on both an individual and an aggregated basis and use such information to enhance the operation of our Services. For example, we collect and use your IP address to diagnose problems with our systems and to gather demographic information. Our third party ad servers will also provide us with summary reports that will tell us how many ads were presented and clicked upon.

You may opt-in to allow Cue to obtain location data for mobile or other devices through which you access and use our Services (such as GPS and cell location data). Cue also may collect your zip code, area code, and other personal location data in the same ways it collects other Personally Identifiable Information. Certain features of our Services, such as location-based push notifications, location check-in services, and merchant location services, require location data to function. If you have opted to use such features, we may use your zip code, telephone area code, and other personal location data, and (if you have opted to allow its collection) location data for your device, to serve you location-specific notifications, merchant information, and ads; to offer you location-specific discounts and promotions; and, at your request, to share your location with friends and other individuals or with a third party, such as a social network.

We send you push notifications from time-to-time in order to update you about any events or promotions that we may be running. If you no longer wish to receive these types of communications, you may turn them off at the device level. To ensure you receive proper notifications, we will need to collect certain information about your device such as operating system and user identification information.

(a) Merchant Partners. If you affirmatively authorize us to do so, from time to time we may share your Personally Identifiable Information, as well as information regarding actions you have taken with respect to items (such as your comments and other input on items and your sharing of items) and actions you have taken in connection with the Services (such as the media that you have viewed and the date you began using the Services), with our retail partners so they may, among other things, contact you regarding goods or services in which you may be interested. This may include information you have provided to our Service Partners that you have authorized us to access (for example, information stored in your account with a social network such as Facebook or Yahoo!). We offer you the opportunity to control whether we do so, both at the time you register for the Services or at any time thereafter by accessing and editing your profile page. If you previously have authorized us to share your Personal Information with our retail partners for their direct marketing purposes, and thereafter request that we not do so by accessing and editing your profile page, please note that sometimes these requests may take up to thirty days to process. Also, please note that any information or authorizations you have provided independently to any of our retail partners will not be impacted by any such request. We are not responsible for removing information about you from the database of any third party to whom we were authorized to disclose your Personally Identifiable Information prior to processing your request that we stop sharing such information with them.

(b) Service Providers. From time to time, we may enter into relationships with third parties who provide services to us (e.g., data management and storage services or credit card processing services). In those circumstances, we disclose Personally Identifiable Information that is necessary for such service providers to perform those services. These companies are authorized to use your personal information only as necessary to provide these services to us.

(c) Your Profile; Sharing. Our Services enable you to create a profile, include information about yourself in your profile and identify whether you would like us to contact you via email, your mobile phone or both. If you send a message through our Services to another user, we will disclose your user name to the recipient, as well as your phone number (for text communications) or email address (for email communications). If you use our Services to share an item or other information with a friend or other individual or to post an item or other information to a social network, web feed, or blog, we will disclose to that individual or submit to that social network, web feed, or blog your user name, the item or other information, and, if applicable, your current and future comments, ratings, tags, and other input about that item. We may also disclose or submit, as applicable, certain information you have provided to our Service Partners that you have authorized us to access (such as your user name for a social network).

(d) Non-Personally Identifiable Information. We may provide Non-Personally Identifiable Information about our customers (such as sales and traffic patterns), as well as aggregated information based on Personally Identifiable Information (such as aggregated geographical information) to our merchant partners or other third parties. Please note that if you independently have provided any Personally Identifiable Information to any of our merchant partners, they may associate the information we provide to them about your use of our Services with that Personally Identifiable Information.

(e) Legal matters. We may be required by law enforcement or judicial authorities to provide Personally Identifiable Information to governmental authorities. We fully cooperate with law enforcement agencies in identifying those who use our Services for illegal activities. We may disclose Personally Identifiable Information upon receipt of a court order or subpoena, or to cooperate with a law enforcement investigation. We may use your Personally Identifiable Information to report to law enforcement agencies any activities that we believe to be unlawful. We may also disclose your Personally Identifiable Information if we believe it is necessary to investigate, prevent, or take action regarding significant abuse of any of our Services or the Internet in general (such as voluminous spamming, denial of service attacks, or attempts to compromise the security of information).

(f) Corporate matters. We may provide your Personally Identifiable Information to our parent company, subsidiaries, joint ventures, or other companies under common control with us (in which case we will require such entities to honor this Privacy Policy), or if we are acquired by or merged with (or in discussions regarding being acquired by or merged with) another entity, to that entity. You will be notified via email and/or a prominent notice on our Web site of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.

Our Services may allow you to store your friends’, family’s, and other contacts’ names, email addresses, and other contact information to your account (by inputting that information, by importing contacts, or by choosing to save contact information when you send communications). We collect the username and password for the email account you wish to import your contacts from and will only use it for that purpose. We will use this contact information to store it for you and to send communications to your contacts on your request. If you wish to delete any of this contact information from your account, you may do so by accessing your Cue Connect contact list, checking the box next to the contact name, and clicking “Delete”.

We take commercially reasonable precautions to secure your Personally Identifiable Information consistent with current industry standards. You can access the Personally Identifiable Information in your account through your password and unique customer ID. Do not share your password with anyone. When you enter sensitive information (such as login information and credit card information) on our website, we encrypt the transmission of that information using secure socket layer technology (SSL).

No data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. In addition, there are security and privacy limitations of the Internet, which are beyond our control. Therefore, the security, integrity and privacy of any and all information and data exchanged between you and us through our Services cannot be guaranteed, and any such information and data may be viewed or tampered with in transit by a third party. We assume no responsibility for the security of your data that we may transmit to third parties once that data is in their possession. Technologies such as: cookies, beacons, tags and scripts are used by Cue Connect and our retail partners. These technologies are used in analyzing trends, administering the site, tracking users’ movements around the site and to gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis.

We use cookies to remember users’ settings and for authentication. Users can control the use of cookies at the individual browser level. If you reject cookies, you may still use our site, but your ability to use some features or areas of our site may be limited.

We use Local Shared Objects, such as HTML5, to store content information and preferences. Various browsers may offer their own management tools for removing HTML5.

We partner with a third party to either display advertising on our website or to manage our advertising on other sites. Our third party partner may use cookies or similar technologies in order to provide you advertising based upon your browsing activities and interests. If you wish to opt out of interest-based advertising click here(or if located in the European Union click here). Please note you will continue to receive generic ads.

As is true of most web sites, we gather certain information automatically and store it in log files. This information may include internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data.

We do not link this automatically collected data to other information we collect about you.

This Privacy Policy only governs the collection, use and disclosure of information by us through our Services. Our Service Partners, and other services, software, and websites accessible through or from our Services, have their own privacy policies and data collection, use and disclosure practices. We are not responsible for the policies or practices of third parties, including our Service Partners. Our Service Partners and other companies, which place advertising or other content on our Services, may collect information about you when you view or click on their advertising or content. We do not control this collection of information. You should contact these third parties directly if you have any questions about their use of the information that they collect.

If you choose to share a product with a friend, we will ask you for your friend’s email address. We will automatically send your friend an email with information about that product. This information is stored in the sender’s account as contact information for the sole purpose of sending this one-time email.

Your friend may contact us at privacy@CueConnect.com to request that we remove this information from our database.

(a) Modifying Personal Information. If you would like to modify any Personally Identifiable Information you previously submitted to us, please let us know by accessing and updating your profile or by emailing our Customer Support at privacy@cueconnect.com or by contacting us by telephone 1.800.280.9604 or postal mail at the contact information listed below.

(b) Deactivating and Deleting Accounts. If you would like to stop using our Services, you may choose to either deactivate the account associated with your profile or delete that account. You can deactivate your account by going to My Account and click on “Deactivate Account”. If you deactivate your account, you will not be able to access our Services, but we will not delete your information. You may reactivate your deactivated account at the Site or by other means we may make available to you. If you delete your account, we will permanently delete your profile information from our servers, except as noted below. Deletion of an account usually takes up to 90 days. Once your account is deleted, you will not be able to reactivate it. To request your account to be deleted, please contact us at privacy@CueConnect.com . We will respond to your request to access within 30 days.

(c) Notes about Deletion. Other than by deleting your account altogether, deleting or modifying information you have submitted through our Services (whether in a profile, in a list of items, or otherwise) does not delete that information from our servers. For example, deleting an item from a list of your items does not delete any data that is connected to that item (such as preferences or commentary). Nonetheless, if you delete certain information you may not be able to use our Services (or portions of them) in the future without re-submitting such information. Even if we delete information from our ‘live’ servers, it may remain in back-up storage (including databases kept for archival purposes). We will retain your information for as long as your account is active or as needed to provide you services. Also, we will maintain your information in our database whenever we are required to do so by law.

Our Services are not intended for use by children under the age of 13. We do not knowingly collect Personally Identifiable Information from children under the age of 13. If we find out that we have collected information from children under the age of 13, we will delete that information immediately.

If you disclose your Personally Identifiable Information in public areas on our Services, that information, along with any information disclosed in your communication, can be collected and used by third parties and may result in unsolicited messages from third parties. Such activities are beyond our control and this Privacy Policy does not apply to such information. If you submit any information to public areas on our Services, you do so with the understanding that such information is accessible to all third parties. If you do not want such information to be viewed by third parties, do not share it in public areas.

You can log in to our site using sign-in services such as an Open ID provider. These services will authenticate your identity and provide you the option to share certain personal information with us such as your name and email address to pre-populate our sign up form. Services like these give you the option to post information about your activities on this Web site to your profile page to share with others within your network.

Our Web site includes Widgets, such as the Share this button or interactive mini-programs that run on our site. These Features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the Feature to function properly. Widgets are either hosted by a third party or hosted directly on our Site. Your interactions with these Features are governed by the privacy policy of the company providing it.

You may also provide personal information about other people, such as their name, date of birth and gender. This information is only used for the sole purpose of completing your request or for whatever reason it may have been provided.
